These Terms and Conditions apply to photoshoot bookings and gift card purchases with Rudenko Photography. In these Terms, “I” and “me” refer to Rudenko Photography, and “you” refers to the person or organization making a booking or purchasing a gift card, depending on the context.

Definitions
‘Photoshoot’ means the photo session you book. ‘Booking’ means the photoshoot together with any add-ons or extensions purchased or agreed in connection with it. ‘Gallery’ means the online gallery through which your photos are made available. ‘Photos’ means the images created as part of your booked photoshoot and made available through your gallery.
Booking and Payment
Every booking includes a €50 deposit. At checkout, you can pay the €50 deposit or the full booking amount. If you pay in full, €50 of that payment is treated as the deposit for cancellation and rescheduling purposes. If you choose the deposit, the remaining amount is due on the day of the photoshoot and can be paid by tap to pay or through a secure payment link. The checkout total includes any travel costs to your location.
Gift Cards
A photoshoot gift card can be redeemed for the photoshoot stated on the gift card, even if the price of that photoshoot increases after the gift card was purchased. The gift card must be redeemed in full and cannot be used partially. Add-ons, location surcharges, or other items not included in the gift card remain payable separately.
Gift cards are valid until the expiry date shown on the gift card, which is at least two years from the date of purchase. An unused gift card can be refunded during its validity period to the original payment method used to purchase it, which means the refund goes to the person who bought it.
Once a gift card has been redeemed for a booking, any cancellation or refund follows the Cancellation and Rescheduling Policy, and the €50 deposit rule applies in the same way as for any other booking paid in full. If a redeemed gift card booking is eligible for a refund, the refundable amount is returned to the original payment method used to purchase the gift card rather than reinstated as gift card credit.
Duration, Extensions and Breaks
Your photoshoot is booked for a set duration. You may end it early if you wish, but this does not reduce the agreed price. Extensions are subject to availability and should be agreed in advance; additional time is charged at the applicable rate. For photoshoots of 6 hours or longer, I take a 30-minute meal break in addition to the booked photography time. Please provide a meal during this break. If that is not possible, let me know in advance so I can bring my own.
Location and Venue
Photoshoots take place outdoors or at professional venues. I do not offer photoshoots at private residential locations, including homes and rental accommodation. You are responsible for checking and following any venue rules and for any venue costs. I am not responsible for damage to clothing or decorations caused by weather or the surroundings, unless the damage results from my own actions or negligence. If your outfit needs assistance, for example carrying or arranging a wedding dress, please arrange for someone in your party to help.
My Approach
The final photos reflect my artistic style and professional judgment, as shown throughout my portfolio. Because photography is creative and conditions vary, specific images, poses, backgrounds, or exact reproductions of reference photos cannot be guaranteed.
I do not post-edit or retouch the photos. The film aesthetic is created in camera through my choice of equipment and settings, so retouching appearances, removing objects, or otherwise altering the scene is not part of the service. Colors may appear slightly different from one screen to another, since displays are calibrated differently.
Delivery and Your Gallery
Standard delivery is normally within 5 days after the photoshoot, provided any outstanding balance has been paid. If the outstanding balance is paid later, the delivery period starts from that payment date. With Priority Delivery, this delivery period is 1 day. Standard delivery may take longer during peak season, public holidays, and weekends. Priority Delivery does not apply to analog photos. The standard delivery period applies, although delivery may take slightly longer depending on the lab’s processing time.
The photos created during your photoshoot are made available in your gallery. The number of photos included in your booking depends on the photoshoot type and duration and is shown when you book. You can download the number included in your booking at no additional charge. Any further photos you select from your gallery are €7 each. Digital RAW files are not delivered. Original film negatives are only provided when the Original Negatives add-on is selected.
Your gallery stays available for one month from the date it is delivered. The Extended Gallery add-on keeps your gallery available for one year from the delivery date and includes five additional photos at no extra charge. Reminder e-mails are sent before your gallery expires, so please download and back up your photos in time. Once your gallery has expired, the gallery files and any backups held by Rudenko Photography are deleted and cannot be restored.
Prints
Your photoshoot includes a €25 print credit, which you can use for print products ordered through your gallery. The credit is not transferable, cannot be exchanged for cash, and expires when your gallery expires.
Using Your Photos
You can download, share, and print your photos for personal use. When you post them publicly, please credit Rudenko Photography. Commercial use, including advertising, business promotion, resale, or licensing to others, needs my written permission in advance, and credit is a condition of that permission.
If you book a Business photoshoot, you may use the photos to promote your own business, including on your website, social media, presentations, and marketing materials. Please credit Rudenko Photography where reasonably practicable. Resale, licensing to third parties, or use outside your own business needs my written permission in advance.
Please do not apply filters or edits that change the look of the photos. Cropping or resizing for social media or other formats is fine.
Copyright
I retain the copyright to the photos I create. Your rights to use the photos are set out under Using Your Photos. Any other use or third-party publication requires my written permission, unless permitted by law.
Portfolio Use
By booking a photoshoot and accepting these Terms, you give me permission to feature the photos in my portfolio, including on my website, social media, and other promotional channels. You can withdraw this permission at any time. After that, I will stop using the photos for promotional purposes and remove them from channels under my control where reasonably possible.
Working Together
We both agree to a respectful collaboration to get the best possible result.
To help me work effectively, please arrive on time, share any details or requests in advance, and let me know if there are specific people you would like photographed. If you would like group photos, please help me identify and gather the people involved. I am the only photographer retained for your photoshoot. Please ask everyone attending not to interfere with my work and to refrain from flash photography, which affects exposure.
What I Cannot Guarantee
Because a photoshoot is limited in time, I cannot guarantee coverage of specific moments or people where this is prevented by weather, lateness, venue rules or restrictions, interference by other cameras or flashes, people who do not appear or cooperate, people I have not been able to identify or gather, or details that were not shared with me in advance.
I am also not responsible for the actions of other suppliers or third parties present during your photoshoot, or for access being refused or withdrawn by a venue or authority.
Force Majeure
Force majeure means circumstances outside my control that prevent me from carrying out the agreement, such as death, severe unexpected illness or injury, government-mandated obligations, transport disruption, natural disasters, terrorism, civil or political unrest, pandemic, travel restrictions, safety and security threat advisories, or changes to visa or passport requirements.
If I am unable to carry out your photoshoot due to force majeure, you can choose to reschedule or receive a full refund of all amounts paid or applied to the affected booking. I have no further liability beyond this, except where the law provides otherwise.
Technical Failure and File Loss
If, without fault on my part, the photos are damaged or lost due to camera or memory card malfunction, theft, or another cause, any liability is subject to the limitation set out below.
Limitation of Liability
To the extent permitted by law, my liability is limited to the total amount paid or applied to the affected booking, including any gift card amount used. This limitation does not apply where liability cannot legally be excluded or limited. I am not liable for indirect or consequential loss, including costs relating to the occasion itself.
Cancellations and Rescheduling
Cancellations and rescheduling are subject to the Cancellation and Rescheduling Policy.
Personal Data
The processing of personal data is subject to the Privacy Policy.
Cookies
The use of cookies is subject to the Cookie Policy.
Applicable Law
These Terms are governed by Dutch law. Any mandatory consumer rights that apply to you remain unaffected.
Changes
These Terms may be updated from time to time. The version that applies to your booking is the version in effect when you make your booking. The terms governing a gift card are those in effect when the gift card is purchased; when the gift card is later used to make a booking, that booking is subject to the Terms in effect when the booking is made. The date above shows when this page was last changed.
